O1 visum

Ik ken dit visum niet en ook hier wordt dit visum niet vaak genoemd. I
k heb het via de search optie geprobeerd maar kan daar iig geen topic vinden met de naam O1 visum in de titel. Wie weet wat meer over dit visum???

Hier alvast mijn eigen bevindingen. Ik laat deze topic staan omdat, zoals ik al aangaf, er hier op dit forum niet echt een duidelijk onderwerp over gaat.

Maar wat vinden jullie van dit visum. Het klinkt erg interessant aangezien je er geen aantal limiet is per jaar.


The O1 visa is designated for aliens of extraordinary ability in the sciences, arts, education, business or athletics. The O1 visa is very helpful for artists, athletes, entertainers, high-end chefs, and business people lacking professional degrees. There is no prevailing wage requirement, the O1 visa may be extended indefinitely and there is no numerical limit to the number of O1 visas issued.

The O1 visa is a good option for J1 visa holders who are subject to INA §212(E) and have not obtained a waiver. The J1 visa holder can apply for an O1 visa via third country processing.

Scientists, educators, business persons and athletes who wish to qualify for the visa must show three of the following:

Receipt of nationally or internationally recognized prizes/awards for excellence in the field;
Membership in associations in the field that require outstanding achievement of their members, as judged by recognized national or international experts;
Published material in professional or major trade publications or major media about the alien;
Participation on a panel or as a judge of the work of others in the same or an allied field of specialization;
Original scientific, scholarly, or business-related contributions of major significance;
Authorship of scholarly articles in professional journals or other major media;
Current or previous employment in a critical or essential capacity for organizations and establishments that have a distinguished reputation; or,
Past or proffered high salary or other remuneration for services, evidenced by contracts or other reliable evidence.
Artists and Entertainers (except TV or movie stars) who wish to qualify for the visa must show three of the following:

as performed/will perform services as a lead/starring participant in productions/events with distinguished reputations as shown by critical reviews, ads, publicity releases, publications, contracts, or endorsements;
National/international recognition for achievement through critical reviews, other published materials by or about the beneficiary in major papers, trade journals/magazines, etc.;
Has performed in a lead, starring or critical role for organizations and establishments that have a distinguished reputation evidenced by media articles, testimonials, etc.;
Has record of major commercial or critically acclaimed success;
Has achieved significant recognition from organizations, critics, government agencies, recognized experts;
Has commanded or will command a high salary/other remuneration in relation to others in the field.
Artists and Entertainers in connection with TV or Movies who wish to qualify for the visa must show a very high level of accomplishment in the motion picture or television industry evidenced by a degree of skill and recognition significantly above that ordinarily encountered to the extent that the person is recognized as outstanding, notable, or leading in the motion picture or television field.

Spouses and children of the O1 visa holder may obtain an O-3 visa to enter and remain in the US. The O3 visa holder may attend school but if he or she wishes to work, he or she must change his or her status to obtain a work visa.

For whom is an O1 Visa appropriate?
Foreign nationals who have received major prizes or awards or other recognition for outstanding achievements in the field of arts, sciences, education, business or athletics and with a job offer from a U.S. company

What are the requirements for obtaining an O1 Visa?
An O1 classification applies to:

An individual alien who has extraordinary ability in the sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim and who is coming temporarily to the United States to continue work in the area of extraordinary ability; or
An alien who has a demonstrated record of extraordinary achievement in motion picture and/or television productions and who is coming temporarily to the United States to continue work in the area of extraordinary achievement.

MarcelJesse, ik weet niet of je zelf een idee hebt mogelijk op dit visum naar de US te komen. Wat ik ervan heb begrepen is, dat er nogal wat haken en ogen aan zitten. Tenzij je de Nobelprijs hebt gewonnen, dan is je extraordinary ability wel aangetoond natuurlijk.
Een cruciale zin in de vereisten is: that the applicant must demonstrate to possess "a level of expertise indicating that he/she is one of the small percentage who have risen to the top of the field of endeavor.
Dus denk aan sportlieden in winnende teams op wereldniveau; een wetenschapper die research doet waarover lovend wordt geschreven in de (internationale) vakpers; mensen die zoveel kennis en ervaring hebben dat ze regelmatig voor jury's gevraagd worden andermans prestaties - ook van zeker niveau - te mogen beoordelen; artiesten die tot de top behoren van hun professie, dit aantoonbaar via prijzen, recensies enz.; een zakenman die snel carriere heeft gemaakt, van een of meer bedrijven een succes heeft gemaakt en waarover positief geschreven wordt in de pers.
Kortom het is nogal wat.
Tenzij jij (en je advokaat !) heel zeker weet dat je voldoende onderbouwing hebt voor je claim van e.a., is het een vrij riskante onderneming. Natuurlijk zullen meer gegadigden deze route proberen, nu de H-1 visa's zo gecapt zijn. Maar wat ik ervan heb begrepen zijn de eisen echt hoog en is de kans op afwijzing groot. Je verliest dan tijd, geld en moet alsnog proberen je werkvergunning via bv. H1(B) te verkrijgen.
Het O-visum is ook voor pop-groepen (top-acts) die een toernee door de States gaan maken.

Ik denk niet dat hier veel ervaring is met dit visum. Ik vermoed dat weinigen op dit forum tot deze top van zakenlieden, artiesten, wetenschappers, atleten enz. zullen behoren. Als je op zo een niveau werkzaamheden verricht zul je ook weinig tijd overhebben om eens lekker te forummen, lijkt me zo. Maar wie weet....

Bedankt voor je inbreng in dit onderwerp. En ook bedankt voor de link die je erbij hebt gedaan.

Ik ben een wetenschapper die research doet en ben aardig bezig. Ik heb al meerdere internationale publikaties op mijn naam staan en hoop binnen twee jaar te promoveren en mijn PhD te halen. Ik ben dus wel bezig met de langere termijn omdat ik zeer goed voorbereid wil zijn voordat ik echt begin. Een collega van mij heeft namelijk dit O1 visum gekregen vandaar dat ik er over ben begonnen. De Nobel prijs is voor maar heel weinig mensen weggelegd maar ik ben wel bezig met iets erg leuks.

Als je op zo een niveau werkzaamheden verricht zul je ook weinig tijd overhebben om eens lekker te forummen, lijkt me zo. Maar wie weet....

Ook mensen op dit niveau (nee ik ben er nog niet helemaal maar ik kom eraan) hebben een prive leven, houden van amerika, en hebben ook moeite om in amerika te geraken!!!

Hoi, dan denk ik dat je eens uitgebreid moet lunchen met je collega en hem eens goed moet uithoren ! En noteer ook de naam van de advokaat die voor hem gewerkt heeft voor dit visum. Want, en dat heb ik al vaker geschreven hier, het kan veel uitmaken, wat voor toon de advokaat zet.
Met een PhD, research, en publikaties ben je natuurlijk al aardig op weg.
Maar houdt toch in de gaten wat er gebeurt met de H1(B) visums, wie weet wordt het quotum weer verhoogd met een paar jaar of worden voor gegadigden met hogere opleidingen extra visums beschikbaar gesteld in bepaalde categorien. Op een gegeven moment wil je naar de US om te wonen/te werken, hoe je binnenkomt (als specialty worker of als alien of e.a.) maakt dan niet uit. Wel kan een O visum eindeloos verlengd worden.
Maar als je erg goed bent is er voor de Groene Kaart ook een e.a. categorie, waarbij je geen werkauthorizatie-procedure hoeft te doorlopen. En zoals ik al vaker heb geschreven, juist de authorizatie is de grootste hobbel en kost de meeste tijd.

Ik hou zeker alles in de gaten oortjes. Als jij nog inside information hoort zou je dat dan ons willen laten weten.

Een advocaat wil ik zeker in handen nemen. Sommige zeggen het zonder te kunnen maar die procedures laat ik liever aan de professionals over.

Nog even een aanvulling op iets dat ik hierboven schreef. H1(B) gegadigden die gaan werken voor een non-profit research centre, een universiteit of de overheid, tellen op dit moment (nog ?) niet mee voor de jaarlijkse cap.

Weet je zeker dat deze mensen niet mee doe met de jaarlijkse cap. Ik vertrouw je kennis maar dit is de eerste keer dat ik hierover hoor en zou voor mij een uitkomst zijn!!!!
