Dit betekent dus als je visum status verloopt terwijl je in de VS wacht op een verlenging of transfer van je H1B of J1 (wat uit ervaring maanden kan duren, bij mij 9!) of op het toekennen van een green card en die petitie wordt afgewezen, dat je op dat moment gelijktijdig met je denial een Notice to Appear kan ontvangen van USCIS. Een "NTA" is de officiele start van het deportatie proces.By indicating that an NTA will be issued when, “upon issuance of an unfavorable decision on an application, petition, or benefit request, the alien is not lawfully present,” the new guidance implies that it will not matter if the person issued the NTA was lawfully present until just prior to the unfavorable decision. That is, if an applicant for extension of nonimmigrant stay, change of nonimmigrant status, or adjustment of status was protected from the accrual of unlawful presence by the pendency of their application, but became unlawfully present the day that the denial was issued and mailed, it would seem that an NTA will follow.
Given the substantial processing times for many applications for change of status or extension of stay, this criterion could capture a great many nonimmigrants who in good faith applied to change to a different status, or extend their stay, well before their initial period of authorized stay expired.
Voor 28 juni mocht ICE of Border Patrol NTA's uitgeven. Nu mag USCIS ze met een petition denial mee sturen. Voorheen stond er in de denial letter dat je binnen 30 dagen het land moest verlaten "or risk becoming deportable". Met deze policy change is het de bedoeling dat je op het moment van afwijzing direct in het deportatie process terecht komt met alle gevolgen van dien.
Dit klinkt misschien allemaal erg gecompliceerd en ver-van-mijn-bed maar de implicaties zijn groot. Zelfs dus als je al je paperwork netjes op tijd filed en je aan alle regels houdt betekent een afwijzing die te lang op zich laat wachten de start van het deportatie proces.
Ik post dit hier omdat ik zelf in 2015 bovenstaande situatie ben overkomen. Ik had een H1B waarvan de verlenging werd afgewezen. Omdat het zo lang duurde was mijn originele H1B verlopen. Terwijl je "petition pending" is ben je beschermd. En nadat mijn petition werd afgewezen had ik 30 dagen de tijd om vrijwillig te vertrekken. Nu zou deze situatie een NTA betekenen.
Met premium processing kan je dit risico vermijden. Betekent wel dat het visum proces nu dus bijna "verplicht" nog duurder word (en je kansen hetzelfde blijven).
